1. About These Terms
These Terms of Use (“Terms”) govern the relationship between you and Mindflow Interactive Limited (“Mindflow Interactive,” “we,” “us,” or “our”) regarding your access to and use of Bloo Party Mix, our websites and related services.
By downloading, accessing or using the Services, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
We may update these Terms from time to time. When we do, we will post the updated version on this page and update the “Last updated” date above. Your continued use of the Services after an update becomes effective constitutes your acceptance of the revised Terms.
2. Eligibility
You may use the Services only if you are legally permitted to do so under applicable law. If you are under the age of majority in your country or region, you should review these Terms with your parent or legal guardian before using the Services. Certain features or content may be subject to age restrictions under applicable law or platform rules.
3. Game Description
Bloo Party Mix is a freemium party game made of simple and accessible mini-games. The game may be played solo, in duo or in team mode depending on the selected mini-game.
Bloo Party Mix is designed around balloons, memory, attention, reflexes, rhythm, breath, movement, playful challenges and collaborative progression. Some mini-games are designed for solo practice. Others are designed for duo or team play with up to 4 players. The collaborative modes are based on shared progression. Players pass levels together and can go further as a group.
4. Platform Player Services
Bloo Party Mix does not provide its own account system. Where applicable, the game uses the native player services of each platform - Game Center on iOS and Google Play Games on Android - which are governed by Apple and Google respectively.
You are responsible for keeping your platform credentials (Apple ID, Google account) secure, and for activity that occurs through the platform player profile linked to your device. We may suspend, restrict or limit access to game features if you breach these Terms, violate applicable law, misuse the Services, or if we are required to do so by law or by a platform provider.
5. Virtual Items and In-App Purchases
The Services may allow you to purchase, earn or otherwise obtain virtual currency, collectible Balloons, avatar items, boosters, cosmetic items, consumables or other digital content (“Virtual Items”).
Virtual Items are licensed, not sold. They have no cash value, are non-transferable and may not be redeemed for money or for anything outside the Services.
Bloo Party Mix is a freemium game and may offer optional in-app purchases. All payments are processed by the platform provider or authorised payment processor through which the purchase is made. Except where required by applicable law or platform policy, all purchases are final and non-refundable. We may add, modify, remove, restrict or discontinue Virtual Items at any time.
6. Advertising
Bloo Party Mix may display advertisements, including advertisements served by third-party advertising providers. In connection with ad delivery, fraud prevention, measurement, frequency capping or interest-based advertising where permitted, we or our service providers may send personal information or device-related information to advertising partners.
You may opt out of interest-based advertising where such opt-out is available by using any privacy choices or consent tools provided in the game, adjusting your device advertising and privacy settings, resetting or limiting your advertising identifier through platform settings, or contacting us at bloopartymix@mindflow-interactive.com. 7. User Conduct
You agree not to:

Use the Services for unlawful, fraudulent or abusive purposes

Upload, transmit or share unlawful, threatening, harassing, hateful, defamatory, obscene, sexually explicit, discriminatory or otherwise harmful content

Impersonate another person or entity

Infringe the intellectual property, privacy, publicity or other rights of any third party

Use cheats, bots, exploits, unauthorised automation, mods or third-party tools

Interfere with the operation, stability or security of the Services

Attempt to gain unauthorised access to accounts, systems or data

Sell, rent, sublicense or commercially exploit any part of the Services, including Virtual Items

Misuse collaborative or team gameplay features

Use the Services in a way that endangers yourself or others, especially in movement-based games
We reserve the right to investigate violations and to take appropriate action, including content removal, feature restrictions or access termination.
8. Safety Notice for Movement-Based Games
Some Bloo Party Mix mini-games may involve physical movement, such as jumping, blowing into the microphone, holding the phone or playing outdoors. You are responsible for playing safely. You agree to:

Stay aware of your surroundings

Avoid playing near roads, stairs, obstacles, water or dangerous areas

Stop playing if you feel discomfort, dizziness, pain or fatigue

Supervise children where appropriate

Follow any safety instructions displayed in the app
Mindflow Interactive is not responsible for injuries, damage or losses caused by unsafe use of the Services, to the extent permitted by applicable law.
9. User Content
The Services may allow you to create or share content such as usernames, messages, profile content, avatar selections or other material (“User Content”). You retain ownership of your User Content. However, by submitting User Content, you grant Mindflow Interactive a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and otherwise process that User Content solely to operate, maintain, improve, secure and promote the Services.
You represent and warrant that you have the rights necessary to submit the User Content and that your User Content does not violate applicable law or the rights of others. We may review, moderate, remove, edit or disable User Content that violates these Terms, applicable law or the rights of third parties.
10. Intellectual Property
The Services and all related content, including software, code, graphics, designs, interfaces, text, music, audio, characters, Balloons, logos, trademarks and gameplay elements, are owned by or licensed to Mindflow Interactive and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your personal, non-commercial entertainment purposes only. You may not copy, reproduce, distribute, modify, reverse engineer, decompile, publicly display, publicly perform, create derivative works from or otherwise exploit the Services except as expressly permitted by law or by us in writing.
11. Suspension and Termination
We may suspend, restrict or terminate your access to the Services if you violate these Terms, violate applicable law, engage in harmful or abusive conduct, interfere with the Services, or if we are required to do so by law or by a platform provider.
You may stop using the Services at any time. You may also request deletion of personal data by contacting us at bloopartymix@mindflow-interactive.com or by using the form available at /bloopartymix/delete-account. Upon termination, your right to use the Services ends immediately, and you may lose access to game progress, User Content and Virtual Items, to the extent permitted by law.
12. Data Deletion
Bloo Party Mix does not allow account creation; player identity is handled by Game Center (iOS) and Google Play Games (Android). There is therefore no Bloo Party Mix account to delete.
You may request deletion of personal data we process in connection with the app through our website at /bloopartymix/delete-account or by email. Deleting this data does not automatically cancel subscriptions, refunds, payment obligations or purchase records managed by Apple or Google.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory. We do not guarantee that the Services will be uninterrupted, secure, error-free or compatible with every device, operating system or network.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Mindflow Interactive and its affiliates, officers, employees, licensors, partners and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities arising out of or relating to your use of, or inability to use, the Services.
To the extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or relating to the Services shall not exceed the total amount paid by you to us for the Services during the six months preceding the event giving rise to the claim, or EUR 100, whichever is greater. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Ireland, without prejudice to any mandatory consumer protection rights that may apply in your country of residence. Any dispute arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the courts of Ireland, unless applicable law provides otherwise.
16. Changes to the Services
We may update, modify, suspend or discontinue all or part of the Services at any time, to the extent permitted by applicable law.
17. Miscellaneous
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
